1. The firm represented Dr. Eric Kaplan and his wife Bonnie, who were temporarily paralyzed when Dr. Bach McComb injected the two with botulism toxin instead of its low dose derivative, Botox. The case, which made national news and was featured on Dateline, settled for a confidential amount.
2 One of most exposing cases the firm has ever handled dealt with involved Carlos Candelario-Herrera, who was born without arms or legs as a result of his mother working in tomato fields and being sprayed with pesticides. Discovery in the case pointed out numerous violations by Ag-Mart, the company employing Carlos’ mother, including immigrant smuggling and sub-par work conditions. This highly televised case settled in 2008 for a confidential amount.
3. After Jessica Riobe was seriously injured when she was ejected from the Grativtron ride at the Miami-Dade County Youth Fair, Grossman Roth represented her and one other victim. Further investigation showed that a sheared bolt on the ride failed to keep a panel in place, thus causing the accident. The case was settled for a confidential amount.
4. In one of the most publicized lawsuits against Florida Power & Light, the firm represented the family of young teen Jill Goldberg, who died in a car accident in Pinecrest when an FPL work crew cut power after a minor lawn fire. One of the crewmembers disconnected power to the wire, but later pulled out a fuse to a transformer box that controlled the traffic signal. The Goldberg car was hit by another vehicle. Jill Goldberg was airlifted to Jackson Memorial Hospital where she died hours later. The firm tried the case and received a $37 million verdict.
5. Grossman Roth represented former Baltimore Orioles pitching great Jim Palmer in a lawsuit against Ophthalmologist Dr. Tom Coffman, for negligence surrounding the removal of Palmer’s cataract and implantation of an artificial lens in his left eye. The case alleged that after the surgery, had Dr. Coffman monitored the situation more closely, Palmer’s retina never would have become detached. Further, Dr. Coffman should never have implanted the controversial multifocal intraocular lens, which is now off the market, in Palmer’s eye in the first place since it was known to create night-vision problems. After a jury trial, Palmer was awarded $890,000 for the fear, pain and lost income he sustained after being forced to undergo the avoidable operation.
6. After the One Bal Harbour condominium crane collapse in 2006, the firm represented 64-year old Connelio Ruiz who was badly injured in the accident. Three fellow workers died when they were buried alive in quick-drying cement, and this case was the beginning of the scrutiny on condominium construction and cranes. The case is still in litigation.
7. The firm represented a husband and wife who sued Coral Springs Medical Center as well as doctors from the Omega Gynecology & Obstetrics Center, for negligence in the birth of the couple’s twins after the wife’s pregnancy resulted in the birth of one severely brain-damaged child. Numerous signs indicating the need for special attention during labor and delivery were overlooked and could have prevented the outcome. As a result, one of the twins is permanently disabled. The case was settled for $9.8 million.
8. After a fuel tanker crashed into a car holding four passengers on Interstate 595 and subsequently exploded, the firm was retained by the family of the late Anita Epstein who was a passenger in the car. Upon further research, the firm found reckless behavior and numerous violations committed by Flavio F. Santisteban, the tanker’s driver, and his employer, Floval Oil Corporation. The case is still in litigation.
9. Grossman Roth is currently representing the family of the late Barry Mazer, who, along with his two-year-old daughter, was struck and killed by a DUI driver on Interstate 95 when Mazer was driving his five children home from Butterfly World. The DUI driver was on his way home from a Miami Dolphins football game and collided into Mazer’s car after making an illegal lane change. (check)
10. The firm represented the surviving spouse and six minor children of Kevin Klotz, who was serving as CFO of Assurant Group, in a wrongful death claim againt Baptist Hospital and ER physicians group for failing to timely diagnose and treat Mr. Klotz for an evolving heart attack. Defendants offered to arbitrate the damages and the case was settled for a confidential amount prior to arbitration hearing and within one year of Grossman Roth’s retention.
11. Grossman Roth represented parents of Kailyn Sosa, who was 1.5 years old at the time of the incident, against Baptist Hospital for severe brain injury caused by the negligence of Baptist employees who failed to timely recognize that Kailyn Sosa had become extubated while she was in the MRI machine undergoing a brain MRI on New Year’s Eve. Defendants offered to arbitrate the damages and the case was settled for a confidential amount prior to hearing.
