After throwing out a 2007 verdict that found neither the hospital nor anesthesiologist Dr. Ivo Baux were responsible for Susan Special’s death during childbirth, a divided Florida Supreme Court ruled that the jury was not given key information during the trial. This decision allows a 52-year-old suburban Boca Raton man a second chance to persuade a jury that the hospital’s negligence forced him to raise their son alone.

Gary Cohen said the new standard is a victory for all victims of wrongdoing, including his client. “We hope we can get him what he deserves, and his son, too,” he said.
