Owners of the boarding barn TMC Performance Horses in Cuba, New York, have brought a lawsuit against a horse feed manufacturer, claiming the company provided the stable with tainted feed. TMC’s case is led by Andrew Yaffa, a partner with Grossman Roth Yaffa Cohen.
In 2016, six of the horses boarded at TMC’s facility fell ill, allegedly showing symptoms of monensin poisoning, a toxic antibiotic that is commonly used in other livestock products that are lethal to horses. Three of the six horses that first showed symptoms died immediately, and the remaining three were euthanized due to their debilitating symptoms.
In total, TMC believes 31 horses were affected by the feed, and all of them will likely die or require euthanizing. The facility’s owners claim that the feed manufacturer was negligent in their preparation of the feed, allowing cross-contamination of the monensin from their other bulk feeds (such as cattle or poultry) to occur.
