We recently secured an eight-figure settlement for a 53-year-old woman, who was left unable to walk or talk after she became a victim of medical malpractice under the watch of a nurse.
Her incident began in a South Florida hospital, where she was undergoing treatment for a brain aneurism. While recovering in a hospital room, she experienced an episode of intensive care unit (ICU) psychosis, a disorder where patients in the ICU for extended periods of time begin exhibiting psychotic behaviors. Agitated and delirious, the patient began pulling on the tracheostomy tube connected to her neck.
The nurse on duty documented that our client had attempted to remove her tubes on six different occasions over a 24-hour period. However, other than by verbal commands, that nurse did not take any actions to prevent the patient from pulling on the tubes.
When the nurse arrived for the next routine check-in, our client was found lifeless on the floor, with all forms of life-support, including her tubes, monitors, IVs, and clothing, removed from her body. She suffered a hypoxic brain injury because of the incident.
