Who Can File a Wrongful Death Claim?

According to the Florida Statutes § 768.19, you may be legally entitled to damages in a wrongful death claim if your loved one’s death was caused by the negligent actions of another person. However, state law mandates that a personal representative of the estate must be the one to bring the claim forward; if no representative is named in the deceased’s estate plan, the court will appoint one.

In compiling the claim, the personal representative will need to list all individuals with a stake in the case. Qualifying individuals include:
