Who Can File a Wrongful Death Claim?

According to the Florida Statutes § 768.19, you may be legally entitled to damages in a wrongful death claim if your loved one’s death was caused by the negligent actions of another person. However, state law mandates that a personal representative of the estate must be the one to bring the claim forward; if no representative is named in the deceased’s estate plan, the court will appoint one.

In compiling the claim, the personal representative will need to list all individuals with a stake in the case. Qualifying individuals include:

  • Parents
  • Surviving children
  • Surviving spouses
  • Blood relatives partially or fully dependent on the deceased
  • Adopted children partially or fully dependent on the deceased

The damages that may be won will depend on the details of the claim. Some damages commonly paid for wrongful death claims are:

  • Funeral and burial expenses
  • Medical bills related to the deceased’s death
  • Pain and suffering
  • Loss of consortium
  • Loss of companionship and protection
  • Loss of companionship and guidance
  • Loss of financial support

Working with a wrongful death lawyer can put you and your family at an advantage. You will be able to rest assure knowing that your claim will be submitted with all documents in order and within the statute of limitations.
