Class Action Lawsuit Filed Against Byte and Dentsply Sirona for Deceptive Sales of Unsafe Teeth Aligners

A class action lawsuit has been filed against Straight Smile LLC d/b/a Byte and Dentsply Sirona Inc., accusing the companies of false advertising and deceptive business practices in the sale of unsafe teeth aligners that have caused severe dental harm to consumers nationwide.
The law firms of Grossman Roth Yaffa Cohen, P.A. & Law Office of Jordan A. Dresnick have teamed up to file the class action lawsuit on behalf of Paula J. Phillips and other purchasers, alleging that Byte and Dentsply misled customers into believing their Byte Aligner Systems and Impression Kits were safe, effective, and adequately overseen by licensed dentists. Instead, numerous consumers have suffered severe pain, bleeding, tooth chipping and tooth loss, allergic reactions, and other dental damage due to the lack of proper oversight and product safety controls.
Key Allegations in the Lawsuit
- Deceptive Advertising: Byte and Dentsply falsely marketed the aligners as “doctor-directed”, “safe”, and an affordable alternative to professional orthodontic care, targeting financially vulnerable consumers.
- Serious Consumer Harm: Hundreds of users have reported adverse effects, including tooth fractures, gum disease, bone loss, and locked jaws, after using Byte’s aligners.
- Failure to Disclose Risks: The companies allegedly knew about complaints and safety concerns but continued selling the product without proper regulatory reporting or warnings to consumers.
- Abrupt Product Suspension: In October 2024, Byte suddenly suspended sales and marketing of its aligners, citing a regulatory review—yet failed to compensate harmed customers or provide refunds.
Plaintiff’s Experience: A Story of Betrayal
Plaintiff Paula J. Phillips purchased a Byte Aligner Kit in April 2024 for $3,338.02, expecting a safe and effective treatment for her teeth alignment. Within weeks, she experienced severe pain and bleeding, ultimately forcing her to stop using the product.
“I trusted Byte’s claims that their aligners were overseen by professionals and designed for safe at-home use,” said Phillips. “Instead, I was left with painful injuries, thousands of dollars lost, and no accountability from the company. This lawsuit seeks justice not just for me, but for all the consumers who have been misled and harmed.”
Legal Action & Consumer Rights
The class action, filed in the U.S. District Court for the Southern District of Florida, seeks to represent all Florida consumers who purchased Byte aligners. The lawsuit demands:
- Financial compensation for affected consumers.
- Punitive damages against Byte and Dentsply for its reckless disregard for consumer safety.
- Injunctive relief to stop Byte and Dentsply from further deceptive advertising and sales of unsafe products.
This is the first federal court action against Byte and Dentsply seeking compensation for consumers of the aligner product. Both law firms stand ready to advocate on behalf of others harmed.
