When Are Drownings Caused by Negligence?

The Centers for Disease Control and Prevention (CDC) estimate that between 2005 and 2014, there were 3,536 unintentional drownings that ended in death, and that over 50% of drowning victims need hospitalization after admittance to the emergency room. Young children make up a disproportionate amount of the drowning totals, due to their lack of experience and coordination in deeper water. Of course, not all of these drowning injuries and deaths are caused by negligence – but when they are, the victims may be able to seek compensation for their losses.

Some of the most common forms of negligence linked to swimming and pool accidents:

  • Failing to supervise children at a swimming pool or beach
  • Faulty pool fence latches or enclosures
  • Lack of safety equipment at a pool or on a boat
  • Failing to call 911 and/or a lifeguard in enough time to help a drowning victim
  • Failing to check for poor weather conditions (for boating activities, scuba diving, etc.)
  • Improperly maintained swimming and scuba diving equipment
  • Inadequately trained supervisors

Depending on the cause of your near-drowning (or the drowning death of a loved one), there could be many different parties responsible to pay damages. In one past case, our attorneys at Grossman Roth Yaffa Cohen represented the parents of twin toddlers who drowned in a Deerfield Beach apartment complex pool. Several residents reported that the pool gate did not fully close all the way and the complex failed to adequately address the problems. As a direct result these two innocent children were able to access the pool unsupervised and ultimately drowned.
